TERMS AND CONDITIONS FOR FIELDGIGS PRO (BETA EVALUATION PHASE)

Please read these Terms and Conditions ("Terms") carefully before using the FieldGigs Pro mobile application and landing page ("Service") operated by FieldGigs Pro ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

1. Beta License Grant & Authorized Use

Evaluation Only: We grant you a personal, non-exclusive, revocable, non-transferable, limited license to use the beta version of FieldGigs Pro strictly for internal testing and evaluation purposes.

No Production Reliance: You acknowledge that the application is in a pre-release "beta" state. You must not use the beta software for the processing of critical, live production data, high-stakes route planning, or real-time financial tracking where errors could result in loss of income.

2. Intellectual Property & Feedback Ownership

Proprietary Materials: The Service, including its original content, features, user interface design, platform templates, database configurations, and underlying logic, remains the exclusive property of FieldGigs Pro and its licensors.

Feedback Assignments: We highly value your feedback, feature suggestions, and bug reports. By submitting any feedback to us via public roadmaps (e.g., Featurebase, Nolt), email, or forms, you agree that all suggestions automatically become the exclusive intellectual property of FieldGigs Pro without any obligation of compensation or credit to you.

3. Disclaimers & Limitation of Liability

"As-Is" Provision: The software is provided "AS IS" and "AS AVAILABLE," with all faults and without warranties of any kind.

No Liability for Financial Losses: FieldGigs Pro shall not be held legally or financially liable for system instability, application crashes, data loss, deleted schedules, or inaccurate routing data. We are explicitly not responsible for any missed appointments, unrecorded invoices, lost gig opportunities, or financial damages resulting from reliance on pre-release software. You assume all operational risk associated with using this tool in physical field scenarios.

4. Third-Party API Acknowledgments

Mapping Services: FieldGigs Pro utilizes the Google Maps API, Leaflet, and third-party place-autocomplete services. Your use of features relying on these maps is subject to the respective third parties' terms of service and network availability. We do not guarantee uninterrupted mapping functionality or precision location data in areas of degraded cellular reception.

Beta Evaluation Agreement

Effective Date: May 26, 2026

This Beta Evaluation Agreement ("Agreement") is entered into by and between FieldGigs Pro ("Discloser") and you, the volunteer beta tester ("Recipient" or "Tester"). By participating in the FieldGigs Pro beta test cohort, downloading, or utilizing the application, you agree to be bound by the terms of this Agreement.

1. Purpose of Evaluation

The Discloser is granting the Tester a limited, non-exclusive, non-transferable, revocable license to use an early, pre-release version of the FieldGigs Pro software application (the "Beta Product") solely for the purpose of evaluation, testing, and feedback.

2. Confidentiality Obligation

The Beta Product, including its user interface, layout, design, workflows, features, performance, and documentation, constitutes proprietary intellectual property and confidential information of the Discloser.

The Tester agrees not to take screenshots, record video, share login credentials, or disclose any details regarding the operational features or code structure of the Beta Product to any third party, including public social media forums, subreddits, or online groups, without express written permission from the Discloser.

3. Feedback and Ownership

The Tester is encouraged to provide feedback, report software bugs, submit routing analytics, and suggest functional updates via support@fieldgigs.pro.

The Tester agrees that all suggestions, feedback, ideas, or feature requests provided to the Discloser will automatically become the sole property of FieldGigs Pro. The Discloser may use, implement, or commercialize this feedback without any obligation, restriction, or financial compensation to the Tester.

4. "As-Is" Status and Disclaimer of Warranty

The Tester acknowledges that the Beta Product is a pre-release version still undergoing technical development and stress testing.

No Warranties: The Beta Product may contain bugs, errors, tracking inaccuracies, or experience periodic data lag and connection dropouts. The software is provided entirely "AS IS" and "AS AVAILABLE".

Assumption of Risk: The Tester assumes all operational risks associated with using the application, including but not limited to mobile data usage, device battery consumption, or navigation routing choices. The Discloser shall not be liable for any financial losses, missed gig opportunities, vehicle maintenance costs, or fuel expenses incurred while evaluating the software.

5. Term and Termination

This agreement is effective upon account registration or access to the Beta Product and remains in effect until terminated.

The Discloser reserves the right to revoke access to the Beta Product, modify templates, wipe testing data, or terminate this evaluation period at any time, for any reason, without prior notice.

Sections 2 (Confidentiality) and 3 (Ownership) shall survive the expiration or termination of this Agreement indefinitely.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Discloser operates, without giving effect to any principles of conflicts of law.

Privacy Policy

FieldGigs Pro ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you use our web application and visit our landing page.

1. Information We Collect

To provide our routing and tracking services, we collect minimal, necessary data:

Account Information: When you sign up via Google Authentication or email, we securely store your name, email address, and profile settings using Firebase Authentication.

Gig Data & Tasks: We store the task names, platforms (e.g., Observa, Field Agent), earnings, and location details that you input or drag-and-drop into your dashboard.

Location Data: FieldGigs Pro utilizes the Google Maps API to provide route optimization. We process location data to calculate efficient routes. Your real-time background location is not tracked or stored when the application is closed.

2. How We Use Your Information

We use the collected data strictly to run and improve the application:

To authenticate your secure login session.

To organize, calculate, and display your optimized multi-stop driving routes.

To calculate and aggregate your Week-to-Date (WTD) and total gig earnings.

To communicate essential system updates or respond to your support requests.

3. Data Sharing and Third-Party Services

We do not sell, rent, or lease your personal information to third parties. To operate the application, we securely pass data to the following standard infrastructure partners:

Google Firebase: For secure user database storage and authentication.

Google Maps API: For real-time map rendering and route calculations.

Stripe: For secure payment processing. Your payment details are encrypted and handled directly by Stripe; we never store your credit card information on our servers.

4. Data Retention and Deletion

Your data is stored securely as long as your account remains active. You retain full control over your data. If you wish to delete your account and permanently remove all associated gig data, templates, and profile settings, you can submit a deletion request at any time by contacting us at support@fieldgigs.pro.

5. Security

We implement strict type checking and hardened security rules on our Firestore database to ensure that only you can read or write your personal data. While we use industry-standard methods to protect your information, no digital storage method is 100% secure.

6. Updates to This Policy

We may update this Privacy Policy from time to time to reflect changes in our features or legal requirements. We will notify active beta testers of any significant changes via email.

Refund & Cancelation Policy

Thank you for choosing FieldGigs Pro ("we," "our," or "us"). We want to ensure you have the best possible experience maximizing your field gig profits. Please read our policy regarding cancellations and refunds carefully.

1. Subscription Cancellations

You are in complete control of your account and billing.

You may cancel your subscription or beta account at any time directly through your user profile settings dashboard or by contacting us at support@fieldgigs.pro.

Upon cancellation, you will retain full access to all premium features, templates, and routing tools until the end of your current billing period.

To prevent being charged for your next billing cycle, you must cancel your subscription before your renewal date.

2. Refunds for Digital Services

FieldGigs Pro provides digital services, cloud database hosting, and instant access to proprietary routing optimization software immediately upon signup or payment processing.

All Sales Are Final: Because our software tools are fully delivered and accessible immediately upon account activation, we generally do not offer refunds or prorated credits for partial months or unused service cycles.

Exceptions: We want to treat our users fairly. If you experience a severe, documented technical error or system outage within the application that prevents you from utilizing the service, please reach out to our support team within 14 days of the charge at support@fieldgigs.pro. We will investigate the issue and handle exceptions on a case-by-case basis.

3. Account Termination

If an account is terminated due to a violation of our Terms of Service (such as malicious database abuse or fraudulent account activity), no refund will be issued.
